FMC walks tightrope on refusal of service rulemaking




The conflict between shippers and container strains highlights a serious problem for the FMC in finalizing rulemaking on when a service can refuse to serve shippers, most notably the danger that it might create a rule that’s so commercially restrictive that it’s unconstitutional.
